a) This indicator presents the total number of files submitted to the conciliator in the conciliation office and the ratio of those that result in reconciliation when the results of these files are examined. The number of files sent to the investigation office with a decision to return was not included in the number of files sent to the conciliation offices. The proportion of conciliated files is calculated by dividing the number of conciliated files by the total number of files processed (the total number of conciliated files, unconciliated files and files with negative settlement proposals) in that year.
b) Mediation: It refers to the method of dispute resolution carried out with the participation of an independent third party with specialist training who brings the parties together in order to negotiate and establishes a communication process between them in order to ensure that they understand each other and thus produce solutions themselves and who can also offer solutions in case the parties are not able to produce solutions. Proportion of files ended by agreement by the type of dispute is calculated by dividing the number of files ended by agreement by the total number of files processed (total of files ended by agreement and non-agreement) in that year. The "Reconciliation" data published by the General Directorate of Criminal Records and Statistics consists of annual data prepared and sent by the Department of Alternative Solutions of the General Directorate of Criminal Affairs of our Ministry, and the "Mediation" data consists of annual data prepared and sent by the Department of Mediation of the General Directorate of Legal Affairs of our Ministry, and are administrative record data. In terms of mediation data; there has been a change in the counting technique in the data sent in 2023, and the said data has been revised compared to previous years. |
